These Terms & Conditions apply to lawn, garden and related services provided by Zac’s Garden Services.
By accepting a quote or engaging Zac’s Garden Services to perform work, you agree to these Terms & Conditions.
Zac’s Garden Services provides lawn and garden maintenance services, which may include:
• Lawn mowingLawn edging
• Whipper snipping
• Garden maintenance
• Hedge trimming
• Weed management
• Green-waste removal
• General garden clean-ups
•Other lawn and garden services agreed with the customer
The specific services provided will depend on the quote or agreement made with the customer.
Quotes are based on the information available to us at the time the quote is prepared.
Where practical, quotes will identify the services included and the price or pricing method.
Unless otherwise stated, a quote does not include additional work that was not reasonably apparent or included when the quote was prepared.
If additional work is requested or becomes necessary, we will discuss the additional work and any applicable additional charges with the customer before proceeding where reasonably practicable.
If you request additional services or changes to the agreed work, additional charges may apply.
We will seek your approval before carrying out significant additional work.
Customers are responsible for providing reasonable access to the areas where work is to be performed at the agreed time.
If reasonable access is not available, we may need to reschedule the service.
Additional charges may apply where a visit cannot reasonably be completed because access was unavailable, provided those charges are communicated appropriately.
Customers should keep pets, children and other people away from active work areas while services are being performed.
Customers should also advise us of any known hazards or conditions on the property that could reasonably affect the safety of people, equipment or the work being performed.
These may include:
Hidden irrigation
Electrical equipment
Unstable structures
Concealed obstacles
Unusual ground conditions
Hazardous materials
Aggressive animals
Other known hazards
We may refuse or stop work where we reasonably consider conditions to be unsafe.
Gardening and lawn-care work can be affected by weather and ground conditions.
We may postpone or reschedule work where weather or site conditions make the work unsafe, impractical, or likely to cause unreasonable damage to the property or lawn.
Where reasonably possible, we will communicate any changes to the customer.
The condition and appearance of lawns, gardens and plants can be affected by factors outside our control, including:
Weather
Water availability
Soil conditions
Pests and disease
Previous maintenance
Plant health
Lawn variety
Irrigation systems
Customer maintenance between visits
We will provide services with reasonable care and skill, but we cannot guarantee a particular plant, lawn or garden outcome where the result depends substantially on factors outside our control.
We take reasonable care when performing our services.
Customers should inform us of existing damage, fragile items, underground services, irrigation, drainage, electrical equipment or other conditions that may be relevant to the work.
Where damage is caused by our negligence or failure to exercise reasonable care, we will work with the customer to address the issue appropriately.
Payment is due according to the payment terms stated on the relevant quote or invoice.
Unless otherwise agreed, payment is expected promptly after completion of the service.
Accepted payment methods may include those specified on the relevant invoice.
Where a recurring service arrangement is agreed, the expected service frequency and pricing will be communicated to the customer.
Recurring services may be changed, paused or cancelled by either party with reasonable notice.
Prices for recurring services may change where circumstances materially change, including significant changes in the scope or requirements of the service. Where this occurs, we will communicate the change before it takes effect.
We understand that circumstances can change.
Customers are asked to provide reasonable notice when cancelling or rescheduling a scheduled service.
Where a cancellation occurs with insufficient notice, or where repeated cancellations prevent us from reasonably providing the agreed service, we may discuss a cancellation or call-out charge with the customer where appropriate.
Any such charge will be communicated before it is applied.
Where green-waste removal is included in the agreed service, the applicable disposal arrangements will be communicated as part of the quote or service.
Where green-waste removal is not included, green waste may be left in an agreed location on the property.
Additional disposal charges may apply where removal has been requested but was not included in the original quote.
We may take photographs of completed work for our records.We will not use identifiable photographs of a customer's property for public marketing purposes without appropriate permission.
Customers are responsible for:
Providing reasonable access to the property
Providing accurate information relevant to the work
Advising us of known hazardsKeeping people and pets away from active work areas
Ensuring any requested services can reasonably be performed at the property
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Where applicable, services provided by Zac’s Garden Services will comply with the consumer guarantees required by law.
To the extent permitted by law, Zac’s Garden Services will not be responsible for loss or damage arising from conditions that were unknown, concealed or outside our reasonable control.
Nothing in these Terms & Conditions limits liability or rights where doing so would be unlawful.
If you have a concern about our services, please contact us as soon as reasonably possible.We will consider the issue and work with you to reach a reasonable resolution.
We may update these Terms & Conditions from time to time.
The Terms & Conditions applying to a particular service will generally be those provided to or agreed with the customer at the time the service is arranged.
These Terms & Conditions are governed by the laws applicable in Queensland, Australia.
